Warrants of Apprehension FAQ
How can SPER issue a Warrant of Apprehension?
SPER has the authority to issue a Warrant of Apprehension to any State or
Territory of Australia under the Service and Execution of Process Act.
Can I make a payment once a Warrant of Apprehension has been issued?
Yes. Providing you have not been arrested in relation to this warrant, you
still have time to contact SPER and either pay in full, or arrange an Instalment Plan.
Please note: if you only make part payment without entering into an Instalment Plan, the warrant will be re-issued immediately.
Once the warrant has been "executed" against you, it will be the decision of the Court as to whether you will be given any further time to pay, or whether you will be required to serve an imprisonment period.
How much time in prison do I have to serve?
If you are arrested on a SPER Warrant of Apprehension, you will be required
to serve 1 day in prison for every $100 of the infringement fine,
or at a rate determined in the original Court Order.
