Warrants of Arrest and Imprisonment FAQ

How many days in prison will I have to serve?
If you are arrested on a SPER Warrant of Arrest and Imprisonment, you will be required to serve 1 day in prison for every $100 of the infringement fine, or at a rate as specified in the Court Order.


Can I make part payments on an Arrest Warrant?
Yes. Part payments will be accepted by SPER before you have been arrested by police. A part payment will result in the warrant being recalled and amended, however it will be re-issued immediately if the payment does not finalise the fine. To avoid being arrested, you should enter into an Instalment Plan or make an up-front payment and the warrant will be recalled. Provided you continue to make the minimum payment each month the warrant will not be re-issued.


Can I have an Instalment Plan on an Arrest Warrant?
Yes, prior to the Warrant being executed. If you cannot afford to pay your fine in full you should apply for an Instalment Plan and the warrant will be recalled. Provided you continue to make the agreed payment each month the warrant will not be re-issued.


Can I do Community Service on an Arrest Warrant?
If you apply to have your fine converted to unpaid community service before you are arrested by police you will be required to undergo a financial assessment and may be granted a fine option order.


Once I have been arrested, can I apply for an Instalment Plan or Fine Option Order?
No. Once the warrant has been served on you your only options are to serve the time in prison or pay the fine (plus costs) in full.
